Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of TekSpert Ai, an AI-powered development tool for Roblox Studio ("the Service"). By creating an account or using TekSpert Ai, you agree to be bound by these Terms.

These Terms are governed by the laws of England and Wales. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or other UK consumer protection legislation.

2. Eligibility

• You must be at least 13 years old to use TekSpert Ai.
• If you are between 13 and 18, you confirm you have your parent or guardian's permission.
• You must provide accurate information when creating your account.

3. Account Responsibilities

• You are responsible for maintaining the security of your account credentials.
• You must not share your account or authentication tokens with others.
• You must notify us immediately of any unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. The Service

TekSpert Ai provides:

• AI-powered code generation and assistance for Roblox Lua development
• Real-time synchronisation between the dashboard and Roblox Studio
• Script editing, game explorer, and template import tools
• Semantic code search powered by AI

The AI assistant is powered by advanced language models. AI-generated code is provided as-is and should be reviewed before use in production games. We do not guarantee that AI outputs will be error-free, secure, or fit for any particular purpose.

5. Tokens & Payments

5.1 Token System

• TekSpert Ai uses a token-based billing system. AI features consume tokens based on usage.
• Tokens are purchased in packages priced in GBP (£), exclusive of VAT.
• VAT will be applied at the current UK rate (20%) where applicable.
• Free features (starter projects, script editor, Studio sync, game explorer) do not consume tokens.

5.2 Payments

• All payments are processed securely by Stripe.
• By purchasing tokens, you authorise Stripe to charge your chosen payment method.
• Prices are as displayed at the time of purchase.
• You will receive tokens immediately upon successful payment.

5.3 Refund Policy

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013:

• Tokens are a digital product and are non-refundable. All sales are final.
• Digital content (tokens) is supplied immediately upon purchase. By completing a purchase, you expressly consent to the immediate supply of digital content and acknowledge that you lose your right to cancel under the 14-day cooling-off period once the tokens are credited to your account.
• We do not offer refunds, exchanges, or credits for any token purchases, whether used or unused.
• Your statutory rights under the Consumer Rights Act 2015 are not affected where the digital content is faulty or not as described.

5.4 Token Expiry

Tokens do not expire. Your token balance is retained as long as your account is active.

6. Acceptable Use

You agree not to:

• Use the Service to generate harmful, illegal, or malicious code
• Attempt to bypass payment systems or manipulate token balances
• Use automated tools to send excessive requests to our API
• Interfere with the Service's infrastructure or other users' access
• Reverse engineer, decompile, or extract source code from the Service
• Use the Service to violate Roblox's Terms of Use or Community Standards
• Resell or redistribute access to the Service or its AI capabilities

7. Intellectual Property

7.1 Your Content

You retain ownership of your Roblox game scripts and code. By using TekSpert Ai, you grant us a limited licence to process your code through our AI systems solely to provide the Service.

7.2 AI-Generated Content

Code generated by AI through TekSpert Ai is provided to you for use in your Roblox projects. You are responsible for reviewing, testing, and ensuring compliance of all AI-generated code with Roblox's policies.

7.3 Our Property

The TekSpert Ai name, logo, dashboard, and underlying software are our intellectual property. You may not copy, modify, or distribute these without our permission.

8. Service Availability

• We aim to provide reliable service but do not guarantee 100% uptime.
• The Service depends on third-party providers which may experience their own outages.
• We may perform maintenance with or without prior notice.
• We reserve the right to modify, suspend, or discontinue any part of the Service.

9. Limitation of Liability

To the fullest extent permitted by law:

• The Service is provided "as is" without warranties of any kind.
• We are not liable for any loss arising from AI-generated code, including bugs, security vulnerabilities, or Roblox Terms violations.
• Our total liability for any claim shall not exceed the amount you have paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any matter which cannot be excluded or limited under UK law

10. Termination

• You may close your account at any time by contacting support@tekspert.ai.
• We may suspend or terminate your account for breach of these Terms.
• Upon termination, unused tokens are forfeited. Tokens are non-refundable.

11. Dispute Resolution

If you have a dispute, please contact us first at support@tekspert.ai. We will try to resolve it informally. If we cannot resolve the dispute, the courts of England and Wales shall have exclusive jurisdiction.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via the dashboard. Continued use after changes constitutes acceptance. If you do not agree with updated Terms, you should stop using the Service and close your account.
